Terms and Conditions of Northwest 35 (Richa Designs Ltd)
1. Introduction
These Terms and Conditions (the “Agreement”) govern all consumer contracts between Northwest 35, a trading name of Richa Designs Ltd, and its subcontractors (“us/we/our”) and the Customer (“you/your”) concerning the sale of goods and services. For clarity, all references to “Northwest 35” in these Terms and Conditions are understood to refer to Richa Designs Ltd.
2. Placing an Order
By placing an order, you acknowledge that you have read, understood, and agreed to these Terms and Conditions. Should you have any questions or concerns, please contact us before proceeding with your order at [email protected]. A contract will only exist between you and Northwest 35 upon our acceptance and processing of your order, which does not affect your statutory rights.
Prices and availability of goods are subject to change without notice. Where applicable, a delivery charge will be added to your order. Please refer to our delivery times and charges.
All quoted delivery dates are estimates and may be subject to change. We accept no liability for any direct or indirect loss or damage should delivery occur on a date other than that estimated.
3. Invoices and Order Confirmation
Upon placing an order, you will receive an invoice and/or order confirmation by email. Please retain this for your records, as we may require information from it in any correspondence. If you do not receive this email, contact us at [email protected] for confirmation of your order.
4. Payment
We accept payments by bank transfer only. We do not accept Mastercard, Visa, Visa Debit, Maestro, or Amex.
All goods remain the property of Northwest 35 until full payment is received.
5. Bank Charges
All bank transfer charges are the responsibility of the payer.
6. Product Description
We make every effort to ensure the accuracy of product descriptions and specifications. However, these are intended as general descriptions and are not binding. Colour reproduction on our website is as accurate as possible; however, variations may occur due to individual screen settings, and we cannot accept responsibility for these differences.
7. Product Size and Colour
All products are handmade, and sizes may vary by up to 10 cm in width or length from the stated dimensions. Similarly, while we use ARS 1400 colour set for accuracy, slight colour variations may occur between rugs due to dye batch differences. By placing an order, you acknowledge and accept these potential variances. For custom sizes, please contact us via our website’s contact page or follow the customisation steps provided with each product.
8. Stock Availability
Our products are made-to-order, allowing customisation to suit individual preferences. We do not hold stock. Standard sizes and suggested colourways are available, but all rugs can be fully customised in terms of colour, shape, size, and material to meet your specifications.
9. Refunds
Orders are non-refundable and non-returnable unless a manufacturing defect is present. A 50% deposit is required on all orders, with the balance due prior to shipping.
Production times are typically between 14 to 18 weeks. Rugs under 5 metres in length may be completed within 12-14 weeks for an additional 15% surcharge to cover double weaving shifts. This timeframe may vary with seasonal demand and our weaving team’s schedule. We will provide an estimated lead time at the point of order or upon request at [email protected]
10. Delivery Times and Charges
Delivery charges are based on volumetric weight and will vary depending on customs clearance, where applicable. International deliveries typically take 7-14 days, and we will provide a more accurate timeframe when delivery is scheduled.
11. VAT
VAT will be charged at the standard rate on all invoices unless a valid EU VAT number is provided by customers in EEC countries, in which case goods will be zero-rated. Non-EEC customers will not be charged VAT but will be responsible for their own country’s VAT and import duties.
12. Title and Risk
Ownership of products remains with Northwest 35 until full payment is received.
13. Force Majeure
Our performance of any contract with you may be subject to variation, cancellation, or extension of time in the event of any circumstances beyond our control, including but not limited to acts of God, war, strikes, lockouts, floods, droughts, or supply chain delays. You agree to accept any reasonable price increases resulting from such events. In all cases, time shall not be of the essence for contractual delivery dates.
For clarification, “Northwest 35” is the trading name of Richa Designs Ltd, and all references to “us”, “we”, or “our” within these Terms and Conditions pertain to Richa Designs Ltd operating under the name Northwest 35.
